'2023 is the Year’: Q&A With U.S. Hemp Building Association President Henry Gage Jr.

The U.S. Hemp Building Association (USHBA) is dedicated to advocating for and supporting the hemp building industry.

In early January, the association submitted hemp-lime (hempcrete) insulation for certification in U.S. building codes. If the certification gets approved, “hempcrete would be permitted as a standard material for residential construction,” Jacob Waddell, USHBA then-interim executive director, told Cannabis Business Times in February.

Cannabis Business Times caught up with Henry Gage Jr., USHBA president and certifications director, to discuss where that certification stands, as well as the association's latest advancements in the hemp building industry and what it has in store for 2023.

Andriana Ruscitto: In early January, the USHBA submitted hemp-lime (hempcrete) insulation for certification in U.S. building codes. Where does that process stand?

Henry Gage: The overview is that we were in Rochester, N.Y., back in April, and we presented before the council (International Code Council (ICC)), and it was overwhelmingly approved as a recommendation. This month when the public review period is complete, and they're having their annual meeting to decide what goes in code and what doesn't, the expectation is that we'll receive an announcement any day that it has been approved along with a list of others.

University of Kentucky Opens Medical Cannabis Research Center

Despite legislation to legalize medical cannabis in Kentucky failing to make headway in the Senate for a third straight year, the University of Kentucky (UK) has opened a center to accelerate research on medical cannabis.

Approved under House Bill 604, the Kentucky Center for Cannabis, located within the UK College of Medicine's Center on Drug and Alcohol Research,  is designed to "advance the study of the use of cannabis and cannabis derivatives for the treatment of certain medical conditions and diseases as indicated and recommended by the center's advisory board," according to the bill text.

Under H.B. 604, the center will receive $2 million over the next two years to aid research costs and participant recruitment. In addition, UK and the center must apply to the U.S. Drug Enforcement Agency to receive a cannabis cultivation license, which will permit the center to conduct "research pertaining to optimal growing conditions," according to a press release.

Kentucky is one of 11 states that has not legalized cannabis for medical use, and a measure to make medical cannabis a reality stalled in the Senate in March for a third time, Cannabis Business Times reported.

National Craft Cannabis Coalition Established

The National Craft Cannabis Coalition (NCCC) has been established to support small, independent cannabis producers across the U.S.

NCCC was officially founded Sept. 20 by six state-level cannabis organizations: Farm Bug Co-Op (Massachusetts); F.A.R.M.S. Inc. (Oregon); Maine Craft Cannabis Association; Origins Council (California); Vermont Growers Association; and Washington Sun & Craft Growers Association. Combined, the six organizations represent more than 1,000 independent cannabis producers.

The coalition’s purpose is to promote state and federal policies that support small cannabis producers as well as a business ecosystem to support craft cannabis cultivation, according to a release.

“Across the United States, thousands of small cannabis farmers and manufacturers have received licenses to operate under state-legal cannabis frameworks with many others seeking to enter the legal market,” said Amanda Metzler, president of F.A.R.M.S. “These producers operate on a much smaller scale than traditional agriculture with many cultivating less than an acre of total canopy. With federal legalization on the horizon, it’s critical that craft cannabis producers organize across state lines to ensure that federal policy includes a level playing field for small and independent businesses.”

Upon its establishment, NCCC announced support for the SHIP Act, which U.S. Rep. Jared Huffman, D-Calif., introduced Sept. 15. The legislation would allow small cannabis producers to sell and ship products within and across state lines.

Greenlight CEO Dives Into Midwest Mission in Missouri

When John Mueller sold Acres Cannabis to Curaleaf in 2019, it was an arm’s length deal with a noncompete that forced him to break ties with what he and his partners had built out West.

As the CEO of Acres, Mueller steered a ship in Nevada that included nearly 270,000 square feet of operating cultivation facilities, a state-of-the-art production and extraction lab, and an immersive 19,000-square-foot dispensary in Las Vegas—the largest retail spot in the state until Planet 13’s SuperStore came along in late 2018.

That Acres dispensary in Las Vegas hosted a “Marijuana Farmers Market” every weekend, offered a museum steeped in cannabis culture, and it had an open-view processing kitchen where customers could look on as technicians worked with edibles and extracts. 

Mueller’s Nevada vision also included another 133,000 square feet of cultivation that was under construction on 37 acres of land the company owned in the Amargosa Valley—an unincorporated area about 75 miles northwest of Las Vegas. Upon completing that undertaking, Acres expected to generate 100,000 pounds of dry flower per year at full scale.

“The day we signed, they pretty much took over operations,” Mueller said of Acres’ $70-million deal with multistate operator Curaleaf. “Obviously, we made sure it was a smooth transaction. We still consider them friends. But there’s no tie between the companies other than we’ve both been good partners to each other on some transactions.”

With ties to the Nevada market severed upon that 2019 sale, Mueller said a new opportunity awaited in the Midwest, where Missouri voters passed a medical cannabis initiative via a 65.6% majority on Amendment 2 in the November 2018 election.

BioPhil Natural Fibers to Open Processing Facility in Lumberton, North Carolina

BioPhil’s Natural Fibers, a company that processes hemp stalk to produce fiber and hurd, is opening a 90,829-square-foot  processing facility in Lumberton, N.C. This would mark the company's second processing facility, with the first in Pennsylvania.

The facility is designed to help the company "expand its production operations with decortication (initial separation of hemp stalk into hurd and fiber) and parallel processing lines that will further clean, refine, and cut hurd and fiber to its client's specifications," according to a press release.

The location will also include "research and development for mycelium load-bearing structural composites by Okom Wrks Labs, as well as prototype development and eventually manufacturing for hurd construction materials and other hemp-based products," according to the release.

The key partners on the project include: the North Carolina Department of Commerce; Economic Development Partnership of North Carolina; North Carolina General Assembly; North Carolina Community College System; Robeson Community College; Robeson County; North Carolina's Southeast; Robeson County Committee of 100; Robeson County Office of Economic Development; and City of Lumberton, according to the release.

BioPhil's Natural Fibers CEO Marcel Dabdoub said the company is excited to expand to North Carolina.

"We enjoyed working with local and regional businesses in Lumberton and surrounding areas during our diligence process, as well as our farmers throughout North Carolina over the past two grow seasons, and we look forward to expanding these relationships," he said.

Medical Cannabis Operator Files Lawsuit Challenging Minnesota’s THC Regulations

Vireo Health, a Minnesota-based medical cannabis operator, filed a lawsuit last week to challenge Minnesota’s THC regulations, claiming that the state’s laws discriminate against the company.

Vireo, which is one of two medical cannabis operators licensed by the Minnesota Department of Health (MDH), brought the civil lawsuit against the department, the state and several county attorneys, according to a local KSTP report.

While Vireo is authorized to distribute THC-infused edibles under Minnesota’s medical cannabis program, new laws took effect July 1 that allow adults 21 and older to purchase edibles and beverages that contain up to 5 milligrams of hemp-derived THC per serving and 50 milligrams per package.

Since Vireo’s products are derived from cannabis and not hemp, the company is still only authorized to sell its products to patients enrolled in Minnesota’s medical cannabis program, KSTP reported. In its lawsuit, Vireo claims these laws “unconstitutionally discriminate” against the company, according to the news outlet.

Vireo goes on to argue that cannabis- and hemp-derived edibles are “chemically identical,” KSTP reported, and that the additional restrictions on cannabis-derived products are “irrational.”

Poll Shows Majority of Maryland Voters Plan to Vote ‘Yes’ on Ballot Measure to Legalize Adult-Use Cannabis

Results of a new poll show that the majority of Maryland voters plan to vote “yes” on a ballot measure to legalize adult-use cannabis on Nov. 8.

The Goucher College Poll revealed that 59% of respondents plan to vote in favor of the ballot question on Election Day, while 34% said they would vote against it and 7% are undecided, according to a CBS News report.

The poll, released Sept. 19, surveyed 1,008 Maryland residents from Sept. 8 through Sept. 12, the news outlet reported, and 748 of the respondents identified as likely voters.

In April, the Maryland House and Senate approved a constitutional amendment for the ballot via House Bill 1.

Missouri Democratic Party Does Not Endorse Ballot Measure to Legalize Adult-Use Cannabis

The Missouri Democratic party supports adult-use cannabis legalization, but it does not endorse Amendment 3, a legalization measure that will appear on the state’s November ballot.

That’s the position the party announced in a news release Sept. 19, according to a St. Louis Post-Dispatch report.

Democrats declined to take a position on the ballot measure due to concerns with its wording, which they said “may negatively impact minorities, people of color, and low-income earning Missourians,” the news outlet reported.

The party’s statement went on to say that “Democrats have concerns about the expungement provisions laid out in the amendment, as well as making it difficult for those who do not currently have a license to enter the industry,” according to the St. Louis Post-Dispatch.

While Trudy Busch Valentine, the Democratic nominee for U.S. Senate, and Alan Green, the Democratic candidate for state auditor, have indicated they will vote for Amendment 3, others in the party, including Missouri Rep. Ashley Bland Manlove, D-Kansas City, have expressed concerns about the measure.

Year-to-Date, Cannabis REITs Provide Key Source of Financing for Businesses

Over $75 million of cannabis sale-leaseback transactions priced in the second quarter of 2022, spanning Massachusetts, Maryland and Texas. Specialized cannabis real estate investment trusts (REITs) have filled the financing need in the cannabis space thus far, and we’ve not yet seen traditional sale-leaseback investors exhibit comfort with the sector. 

Leading up to the first quarter of 2022, the cannabis sector exhibited a general trend of cap rate compression (i.e., increases in the prices of cannabis-related real estate), largely due to increasing confidence of legalization at the federal level as well as the growing strength of credits in the space. 

However, that compression momentum may be slowing due to inflation and interest rate movements affecting the broader market.

That being said, the cost of sale-leaseback capital, while high relative to the overall sale-leaseback universe, still provides for attractive financing levels for cannabis operators due to sector-specific capital constraints. We continue to evaluate the cannabis sale-leaseback landscape as we see the narratives of increasing interest rates and an inflationary environment go up against secular positive drivers of growing multi-national operators and increasing legalization initiatives.

The broader sale-leaseback environment has exhibited significant movement year-to-date. Late 2021 into early 2022 provided for one of the best pricing and execution sale-leaseback environments in sale-leaseback history. However, buyer caution began to creep into the beginning of Q2 ’22 and continued into early Q3 ’22. Many buyers struggled to lock in debt financing, which in turn led to challenges in pricing assets appropriately.

Despite the noise of interest rate hikes, inflation headlines, and pullback in M&A activity, the second quarter of 2022 exhibited 236 discrete transactions and aggregate dollar volume of $10.2 billion (over half of which was a single transaction).

New Zealand Approves First Locally Grown Medical Cannabis Products

New Zealand approved Helius Therapeutics as the country’s first medicinal cannabis company to make products derived from locally grown cannabis.

The decision comes from New Zealand’s Medicinal Cannabis Agency (MCA), which also approved Helius’ Full Spectrum CBD medicines to be locally extracted and manufactured.

A Look at Wayne State University’s Veteran Cannabis Studies

Grants from the state of Michigan are funding research into if cannabis can treat mental health conditions, such as post-traumatic stress disorder (PTSD), and if it can prevent veteran suicide.

Between 2021 and 2022, the state has announced funding for research conducted by scientists at Wayne State University, the University of Michigan and the Multidisciplinary Association for Psychedelic Studies.

More than 1 in 10 veterans who have served in Operations Iraqi Freedom and Enduring Freedom, the Gulf War and the Vietnam War have PTSD, according to the U.S. Department of Veterans Affairs (VA). The VA also states that among veterans who use VA health care, about 23% of women have reported sexual assault when in the military, and about 55% of women and 38% of men have experienced sexual harassment when in the military. 

In 2019 in the U.S., there were 130 suicides per day, and 17 of those deaths were veterans, according to the U.S. Centers for Disease Control and Prevention. Although veterans comprise about 7% of the U.S. population, they represented about 13% of lives lost to suicide that year.

The mental health of veterans was not lost on Michigan voters when they legalized adult-use cannabis via Proposal 1 in 2018. That initiative requires the state to provide $20 million annually “until 2022 or for at least two years” for clinical trials evaluating cannabis’ efficacy in treating U.S. veterans’ medical conditions and preventing veteran suicide.

The state has been working to help ensure a smooth rollout of the studies, says David Harns, public relations manager for Michigan’s Cannabis Regulatory Agency (CRA) and Department of Licensing and Regulatory Affairs.

Alabama legislators passed a medical cannabis legalization bill last year, and now it’s time for prospective businesses to line up for the state’s first licensing cycle.

Business owners may now request an application from the state, an opportunity that will only be available until Oct. 17. From there, applications will be mailed out the following week and due back to the state by Dec. 30. 

The application fee is a non-refundable $2,500 for any license type, though prospective businesses may only apply for one license type.

License winners will be announced June 12, 2023. 

Jay Czarkowski, founding partner of Canna Advisors, said that Alabama is following other states examples by setting up a merit-based application process once the requests are in. The state will be looking for applicants with experience in the industry, as well as access to capital in this more competitive market right now.

“They’re looking for groups that are qualified, that can execute and deliver value,” he said.

Kona Gold announced earlier this year that its Ooh La Lemin Lemonades will be going into modular sets in Walmart stores in select states. With the addition of Oregon, Washington and Alaska, Ooh La Lemin will now be going into modular space in approximately 600 stores. Those stores are located in Alaska, California, Minnesota, Nevada, Michigan, Oregon, South Carolina, Tennessee, Washington and Wisconsin. Rollout to these stores will begin next month.

Kona Gold Beverage recently announced its wholly owned subsidiary, Gold Leaf Distribution LLC, posted record monthly revenue in August. Gold Leaf Distribution posted approximately $348,000 in sales. The increase in sales has been fueled by a culmination of expanding the company's sales team, adding new products, and consumer demand. Gold Leaf expects to see continued growth throughout the rest of the year as it continues to have record revenue growth in 2022.

Majority of Republican Voters Favor Cannabis Legislation: Poll

More than three quarters (76%) of Republican voters agree the federal government should not interfere with individual states’ decisions to legalize cannabis, and should instead remove obstacles to legalization, according to a national poll released Sept. 14.

The poll was conducted by Republican pollster Fabrizio, Lee & Associates on behalf of the National Cannabis Roundtable (NCR).

A similar percentage (73%) of Republicans agree legal cannabis businesses should be entitled to the same rights as other legal businesses. That same percentage of Republicans also support legalizing cannabis for medical purposes, according to the poll.

Additional findings from the poll include 65% of Republicans in favor of legal cannabis companies having access to banking systems like any other legal business, and 56% supporting cannabis conviction expungements in now-legal adult-use states. A slight majority (51%) of Republicans say legal cannabis companies should have access to capital markets and be able to sell stock and be listed on stock exchanges.

On the topic of adult-use legalization, Republican voters were just about split with 47% supporting adult-use legalization and 46% opposing.

“These findings support what I’ve been saying for years: cannabis is no longer the partisan issue it once was,” said Rep. Dave Joyce, R-Ohio, co-chair of the Congressional Cannabis Caucus. “Congress needs to act in a bipartisan manner and enact the change that Americans, both Republicans and Democrats alike, are calling for. It’s past time for the federal government to respect the will of the states that have legalized cannabis in some form and allow them to make their own decisions in the best interest of their constituents without interference from Washington.”

Poll Shows Slim Majority of Minnesota Voters Support Adult-Use Cannabis Legalization

After an adult-use cannabis legalization measure was defeated in the Minnesota Legislature earlier this year, a new poll has revealed that a slim majority of the state’s voters support legalization.

According to a Star Tribune/MPR News/KARE 11 Minnesota Poll, 53% of Minnesota voters believe the state should legalize adult-use cannabis, 26% oppose legalization and 11% are undecided on the issue, the Star Tribune reported.

The poll revealed that 70% of Democrats, 60% of independents, and 29% of Republicans support adult-use legalization, according to the news outlet.

Poll results also showed that roughly 60% of respondents ages 18-49 support legalization, while about half of those ages 50-64 and 47% of those 65 and older also support it, the Star Tribune reported.

The findings are based on interviews with 800 Minnesota voters conducted from Sept. 12 through Sept. 14, according to the news outlet.
