Ayr Wellness Appoints David Goubert as President

MFG Tray Is Now Employee Owned

How Cannabis Businesses Can Leverage Insurance in the Wake of Natural Disasters

A monumental storm, Hurricane Ian left behind a devastating trail of death and destruction. Tragically, more than 100 people reportedly have died as a result of the powerful hurricane, which first made landfall in Florida as a Category 4 storm on Sept. 28, 2022. And, according to multiple reports, the economic damage caused by the catastrophic storm is expected to total tens of billions of dollars.

Unfortunately, but not surprisingly, the cannabis industry (specifically in Florida) did not escape Hurricane Ian unscathed. To the contrary, like other businesses, cannabis-related businesses suffered property damage and (presumably) business-income losses. 

Fortunately, insurance may be available to cover at least some losses. To maximize the potential for any insurance recovery, cannabis-related businesses—again, like other businesses—can and should take several important steps as soon as possible.

Hurricane Ian Hurts Cannabis Industry 

In a press release dated Oct. 6, 2022, Cansortium Inc., “a vertically-integrated cannabis company operating under the Fluent brand,” disclosed that, in addition to some “minimal physical damage” that certain of its stores suffered, one of its “cultivation and packaging facilit[ies] … sustained moderate damage to its HVAC and fertigation system.” The company—which also had to close 12 of its dispensaries “for various periods due to forced evacuations and the uncertain path Hurricane Ian”—further announced that, due to the storm’s impact, it “currently anticipates that it will take approximately 12 weeks to return the [damaged cultivation and processing] facility to the production level that existed prior to the hurricane.”

Cannabis Businesses in Florida, Puerto Rico Reopen Following Hurricanes

In the weeks after two major hurricanes stormed the southeastern corner of the U.S. and its territories, cannabis companies are starting to resume operations. 

Many of Florida’s medical cannabis operations have reopened to serve patients as search-and-rescue teams continue to examine homes and businesses along the Gulf Coast following Hurricane Ian’s wrath.

The Category 4 hurricane brought maximum-sustained winds of 150 miles per hour, and roughly 3.3 million Florida homes and businesses initially lost power during the storm, according to an Oct. 3 Reuters report.

Hurricane Ian has resulted in at least 125 deaths in the U.S., CNN reported Oct. 5.

ACS Laboratory, a cannabis, CBD and hemp testing facility based in Sun City Center, Fla. (about 30 minutes south of Tampa), closed on Sept. 28 due to the storm and did not reopen until Sept. 30. The business sent every employee home and lost power six times during a 24-hour period, said ACS Laboratory Founder and President Roger Brown.

Regulators Issue 30-Day Suspension, $75K Fine to Detroit Cannabis Licensee

An unannounced compliance visit has resulted in a 30-day license suspension and a $75,000 fine for one of Michigan’s medical marijuana provisioning centers.

When Cannabis Regulatory Agency (CRA) officials inspected The House of Mary Jane on May 19, 2021, in Detroit, they “observed multiple bags, backpacks and duffle bags of marijuana products that did not have the tracking identification numbers assigned by the statewide monitoring system (METRC) attached,” according to a complaint released Oct. 10 by the agency.

State officials advised the licensee that none of the products within the unmarked bags could be sold or destroyed until an investigation was completed and guidance was provided by the CRA. The regulators also requested The House of Mary Jane to provide video surveillance for the past 30 days, which is required by the state’s administrative rules, according to the complaint.

The licensee allegedly failed to provide the video surveillance, and, when CRA officials returned to the retail facility six days later and inquired about the untagged cannabis products, the licensee claimed to have destroyed the remaining evidence with “motor oil and had Waste Management remove the destroyed products,” according to the complaint.

“The Cannabis Regulatory Agency has a legal responsibility to protect the health, safety and welfare of the public,” CRA spokesman David Harns said in a public statement. “Our licensees must follow all of the rules and laws that govern the cannabis industry. Untagged marijuana products and the inability to provide video footage is simply unacceptable.”

Except for designated consumption establishments or temporary cannabis events licensed under the Michigan Regulation and Taxation of Marihuana Act (MRTMA), a cannabis business must not have cannabis products that are not identified and recorded in the statewide monitoring system. CRA officials requested for video recordings of the product’s destruction, as required by state code, but the licensee did not provide the surveillance, according to the complaint.

ASTM International Cannabis Committee Approves New Suite of Cannabis Standards

ASTM International’s D37 cannabis committee, a group that develops standards and solutions related to quality and safety for the cannabis and hemp industries, has announced five new standards.

The committee announced four standards Oct. 3:

Standard (D8375) will “provide a method to establish cannabinoid content in cannabis and hemp samples.” The standard will benefit laboratories, producers, researchers, regulatory bodies, and consumers, according to Garnet McRae, ASTM member. The standard can be used by forensic labs to support cannabinoid research and to confirm cannabinoid content in illicit samples, according to the release.Standard (D8399) “will aid laboratories in analyzing cannabis and hemp samples to establish pesticide concentration levels–or lack thereof–to ensure products meet regulatory requirements within appropriate jurisdictions,” according to the release. This standard, which will benefit laboratories, producers, regulatory bodies and consumers according to McRae, will help “address health and safety concerns as well as labeling and regulatory requirements for consumable cannabis products,” according to the release.Standard (D8442) “will provide a method to test for terpenes and cannabinoids in cannabis using gas chromatography,” and will assist in quality control, according to Randall Shearer, ASTM International member. Standard (D8469) will “aid manufacturers, regulatory bodies, and other cannabis industry stakeholders by providing a new test method for metals in cannabis,” according to the release. The testing method will be used to detect dangerous metals and lead in cannabis.

The committee also recently announced a new standard Oct. 10 on medicinal-use cannabis inflorescence.

The soon-to-be-published standard, D8439, will help provide “specifications for cannabis flower that can be used to support sound and reproducible research,” according to the release.

ASTM International member David Vaillencourt said the standard would help provide consistent testing for quality and safety.

Vermont Issues 13 Additional Adult-Use Cannabis Business Licenses

The Vermont Cannabis Control Board (CCB) issued 13 additional adult-use cannabis business licenses Oct. 6, at the board’s first meeting since adult-use sales launched Oct. 1.

Regulators approved three cultivators, four manufacturers, four wholesalers, a testing lab and a retailer Thursday, Heady Vermont reported.

Arkansas Medical Cannabis Sales Hit $200 Million This Year

Arkansas’ medical cannabis sales have hit $200 million this year, with patients spending $23.9 million at the state’s 38 licensed dispensaries in September, according to a local KNWA report.

Patients purchased 4,571 pounds of medical cannabis last month, the news outlet reported, and The Natural Relief Dispensary in Sherwood reported the most sales, with 431 pounds sold.

There are 92,035 patients enrolled in the medical cannabis program, according to KNWA.

“Patients spent approximately $800,000 daily in September on medical marijuana purchases,” Scott Hardin, a spokesperson for the Arkansas Department of Finance and Administration, told the news outlet. “Additionally, 4,571 pounds is the largest month for sales in 2022. Through the first nine months of 2022, patients have spent $205 million to obtain 36,600 pounds of medical marijuana. We anticipate 2022 sales will surpass the $264.9 million spent in 2021.”

Department of Air Force to Allow a Retest for Applicants Who Test Positive for THC

Individuals who apply to the Department of Air Force (DAF) but test positive for THC in the initial test could now be granted a second chance at enlisting. 

DAF announced Sept. 28 that it is implementing a two-year pilot program “that allows a retest for applicants who test positive for THC during the accession physical examination at the Military Entrance Processing Station.”

The new pilot program will allow applicants who test positive for THC to retest after 90 days if they are granted a THC waiver. If applicants pass the second test, they will be allowed to enlist in the DAF. In the past, an applicant who tested positive for THC would have received a permanent bar from entry into the DAF, according to the release.

The THC waiver will be granted to applicants who meet the qualification standards, which include:

Scored 50 or above on the Armed Forces Qualification Test;Has a high school diploma; Is medically fit for service;And does not possess Category 1 or 2 moral violations.

This new policy is effective immediately and applies to the United States Air Force, U.S. Space Force, Air Force Reserve and Air National Guard, according to the release.

Over the next two years, DAF will collect and analyze data “to determine the suitability of adopting this as a permanent change to DAF recruiting and accessions policy,” according to the release.

PA Options for Wellness' Medical Marijuana Presence Grows to Six 'Vytal Options' Dispensary Locations in Pennsylvania

New York Gov. Kathy Hochul told reporters this week that the state is “still on track” to launch adult-use cannabis sales this year, according to a Syracuse.com report.

During an Oct. 5 interview with the Advance Media New York editorial board, Hochul said the state will still realize its plan to have 20 adult-use dispensaries open by the end of 2022, with “another 20” opening roughly every month after that.

“We’re going to make sure that this is a model for the rest of the nation—especially with our desire to make sure that people who’ve been affected by the criminal justice system adversely ... have the opportunity to work in this area,” Hochul said, according to Syracuse.com.

Former New York Gov. Andrew Cuomo signed the Marijuana Regulation and Tax Act in March 2021 to legalize adult-use cannabis in the state. The rollout of the program largely stalled, however, until Hochul became governor in August 2021 after Cuomo resigned amid sexual harassment allegations.

Upon taking the reins last year, Hochul called a special session and appointed members to the New York Office of Cannabis Management (OCM) and Cannabis Control Board (CCB). She also signed legislation to allow the state’s licensed hemp farmers to grow cannabis for the adult-use market, as well as announced a fund and a “Seeding Opportunity Initiative” to promote social equity in the industry.

Maryland Voters Favor Cannabis Legalization: Poll

With a month to go before Maryland voters cast their votes on cannabis legalization in the state, approval seems probable, according to recent data.

Nearly three-quarters (73%) of registered Maryland voters approve of cannabis legalization, while 23% disapprove and 4% have no opinion, according to a poll conducted by The Washington Post and the University of Maryland.

The poll asked respondents the following question: “Do you favor the legalization of the use of cannabis by an individual who is at least 21 years of age on or after July 1, 2023, in the state of Maryland?”

While Maryland voters are largely in favor of legalization, approval for cannabis legalization was also relatively similar across all education levels. Those with post-graduate degrees approve by a 75%-22% margin and those with high school or less approve by a 74%-20% margin. Those with bachelor’s degrees (73%-25%) and those with some college (70%-26%) also overwhelmingly approve of legalization.

Approval by gender was also relatively comparable. More than three-quarters (76%) of males said yes while 20% said no, and females were also in favor but slightly less so, with 69% approving and 26% opposing.
