Alaska Governor Establishes Adult-Use Cannabis Task Force

Alaska Gov. Mike Dunleavy wants to conduct a thorough review of the state’s seven-year-old adult-use cannabis program to help eliminate burdens for the state’s businesses.

Dunleavy issued Administrative Order No. 339 on Sept. 21 to establish the Governor’s Advisory Task Force on Recreational Marijuana, which will review the state’s current tax and fee structures, as well as the current adult-use regulations, and provide recommendations for improvement to the governor’s office.

“In the past seven years Alaska’s marijuana industry has flourished but is still considered a new and evolving industry in Alaska,” Dunleavy said in a public statement Wednesday. “As we would expect to see with any new industry, concerns have been raised about the structure the industry has been operating under. A cornerstone of my administration has been to review unnecessary regulations that are a burden to business, while ensuring oversight to protect the health, life, and safety of all Alaskans. It is my hope that with the formation of the Governor’s Advisory Task Force on Recreational Marijuana, we can bring together a variety of voices and perspectives to evaluate existing provisions and consider recommendations to improve the viability of the industry.”

Alaska voters approved an adult-use cannabis legalization measure in the 2014 election that took effect in February 2015. The initiative levied a $50 per ounce excise tax on the sale of cannabis from warehouses to retailers, and this, among other provisions, is what Dunleavy would like to evaluate.

Maine’s Adult-Use Cannabis Sales Continue to Climb in Second Year

Despite a dismal municipal opt-in rate since coming on board with commercial adult-use cannabis sales nearly two years ago, Maine’s retail market has shown consistent month-over-month growth throughout 2022.

In August, licensed dispensaries recorded more than $17 million in adult-use sales, representing 4.1% growth over July and a staggering 68% increase from August 2021 sales, according to the state’s Office of Cannabis Policy (OCP). Last month featured the largest sales total since Maine launched adult-use sales in October 2020.

Roughly 59% of the $17 million in adult-use sales last month came from usable cannabis (flowers, prerolls, shake/trim), while nearly 23% came from concentrates and 18% came from infused products, according to OCP.

The average retail price for dry flower was $248 per ounce in August, a slight dip from the $278-per-ounce average for the calendar year and a whole so far. In 2021, dry flower averaged $361 an ounce, according to OCP. 

So far in 2022, Maine’s adult-use retailers have sold nearly $98.3 million in cannabis, a 120% increase compared to the same eight-month period from last year. Last year, August represented the largest sales month with $10.1 million in transactions.

The state’s market growth comes despite roughly 10% of municipalities in Maine opting in to allow licensed retailers to set up shop in their jurisdictions. Currently, only 52 towns, cities and plantations among approximately 500 municipalities in the state have a retail footprint, according to OCP.

Georgia Regulators Award Two Medical Cannabis Licenses; Production to Begin Within a Year

The Georgia Access to Medical Cannabis Commission voted Sept. 21 to award two medical cannabis licenses to Botanical Sciences LLC and Trulieve Georgia Inc.

The licenses authorize the companies to grow, manufacture and sell cannabis oil that contains no more than 5% THC, and the companies must begin production within a year, according to The Atlanta Journal-Constitution.

“Trulieve is thrilled to receive a Georgia cannabis production license and we appreciate the commission’s diligence throughout the selection process,” Trulieve CEO Kim Rivers said in a public statement. “We look forward to educating the Georgia market on the numerous health and wellness benefits of cannabis, as well as providing patients statewide access to the medical cannabis they have been seeking.”

Trulieve Wins Georgia Production License to Provide Patients Access Statewide to Medical Cannabis

TALLAHASSEE, Fla., Sept. 21, 2022 /PRNewswire/ -- PRESS RELEASE -- Trulieve Cannabis Corp., a cannabis company in the U.S., today announced the Georgia Access to Medical Cannabis Commission (GMCC) awarded Trulieve GA, Inc. with a Class 1 production license. How to Reach New Customers With Seasonal Product Offerings

Curiosity may have been game over for the cat, but it’s game on for the cannabis consumer.

In an increasingly competitive market, driving consumer interest in new or seasonal products comes from various approaches and marketing maneuvers, including timely offerings that help keep things fresh and alluring.

With the autumn equinox upon the cannabis industry, introducing new flavors for infused beverages, finding the right menu placement for pumpkin-spiced edibles, or hyping up that new product drop on Green Wednesday (the day before Thanksgiving) could draw in new customers or give experienced shoppers a reason to crossover to new market segments.

But acquiring increased interest levels boils down to “offering unique products that spark the curiosity of new customers and give them a reason to try you out,” Oswaldo Graziani, creative marketing director at Florida-based Fluent, tells Cannabis Business Times.

“Being visible with new product drops and offerings is one of the easiest strategies to deploy,” says Brandon Wiegand, chief operating officer at Las Vegas-based Thrive Cannabis Marketplace.

“Seasonality affects most product categories, but the most substantial impact comes with the edibles category,” says Thomas Winstanley, chief marketing officer at Massachusetts-based Theory Wellness.

2022 Cannabis Measure Gets No Dice From Oklahoma Supreme Court

The 48 days it took Oklahoma Secretary of State Brian Bringman’s office to certify signatures has doomed an adult-use cannabis initiative from landing on the 2022 ballot, the state’s Supreme Court ruled Sept. 21.

The 9-0 ruling is despite the court’s justices writing that petitioners from Oklahomans for Sensible Marijuana Laws (OSML), dubbed the Yes on 820 Campaign, “diligently prepared” State Question 820 for submission on the Nov. 8, 2022, general election ballot.

In fact, OSML organizers submitted roughly 164,000 signatures for their petition on July 5—well ahead of an Aug. 1 deadline to submit—but it took Bingman’s office nearly seven weeks (Aug. 22) to certify 117,257 signatures as valid. That beat the required minimum of 94,911 valid signatures.

When OSML advocates dropped off their signed petitions in early July, the secretary of state’s office advised them that the counting and verification process would likely take two to three weeks, “which was historically how long it had taken to manually count signatures,” according to the Supreme Court’s ruling this week.

Furthermore, state officials indicated the signatures could even be validated and certified quicker this year with the secretary of state’s office using newly created software in the counting process. In order to facilitate that process, OSML petitioners met with Bingman’s office to “ensure the signature sheets were formatted and printed correctly” so that the pages would scan through the new system, according to the Supreme Court.

Seattle Mayor Signs Legislative Package to Increase Social Equity in City’s Cannabis Industry

Seattle Mayor Bruce Harrell signed a trio of bills into law Sept. 20 to increase social equity in the city’s cannabis industry, according to a MyNorthwest report.

“I think our city and our country are trying to look at an industry that has been historically used to marginalize communities,” Harrell said, according to the news outlet. “Dare I say, intentionally criminalized communities, and now with the right values and right people, how do we take that industry and advance equity advance opportunity? These policies are quite frankly a necessary step to new generations of injustice and discrimination caused by what was then called the War on Drugs left so many black communities and communities of color so far behind.”

The first bill, CB 120391, establishes a regulatory framework for the city to issue social equity licenses in collaboration with the Washington State Liquor and Cannabis Board (LCB), MyNorthwest reported.

CB 120391 will also create a cannabis advisory committee to gather input on cannabis equity from workers, community members and industry leaders, according to the news outlet.

Connecticut Unveils Public Education Campaign to Promote Responsible Cannabis Consumption Ahead of Adult-Use Market Launch

Connecticut Gov. Ned Lamont announced Sept. 20 the launch of an education campaign to promote responsible cannabis consumption ahead of the state’s adult-use market launch.

The campaign contains resources including information about safe storage and disposal, as well as what to do in case someone—such as a child or pet—accidentally ingests cannabis, according to the press release from the governor’s office.

“Protecting public health and safety includes providing people with the tools and knowledge to make informed decisions to keep their families safe,” Lamont said in a public statement. “We’re working to educate the public about the steps they can take to protect themselves and their families from accidental ingestion and over-consumption. We encourage adults who choose to use these products to do so responsibly.”

The Connecticut Department of Consumer Protection developed the resources in collaboration with the Connecticut Department of Public Health and the Connecticut Department of Mental Health and Addiction Services to be used by businesses both inside and outside of the cannabis industry.

Idaho to Ban Hemp, CBD Products Intended for Animal Use

Idaho is banning hemp and hemp-derived products, including CBD, intended for animal use starting Nov. 1.

The Idaho State Department of Agriculture (ISDA) said in a statement July 20 that it does not acknowledge such products as a legal animal feed or remedy ingredient, adding that these products are also not approved as legal feed ingredients by the U.S. Food and Drug Administration (FDA) or the Association of American Feed Control Officials (AAFCO).

“Safe levels of hemp and hemp-derived products in animal feed have not yet been established under federal or state law. As such, these products are not approved feed ingredients and cannot lawfully be added to or incorporated into commercial feed. This includes feeds, treats and remedies intended for pets, livestock, or any other animal," ISDA said.

New York Regulators Approve Medical Cannabis Home Grow Regulations, Issue New Adult-Use Licenses

New York regulators announced several developments this week in the state’s medical and adult-use cannabis markets, as well as its cannabinoid hemp program.

The Cannabis Control Board (CCB) adopted regulations Sept. 20 to allow medical cannabis patients to grow up to six plants at home, and for caregivers to grow up to 12 plants to serve up to four patients, according to a Syracuse.com report.

The new rules also prohibit landlords from refusing to lease to medical cannabis patients and penalizing them for growing their own plants, the news outlet reported.

The final home grow regulations were revised based on feedback received during a public comment period, according to Syracuse.com, although some voiced concerns that the rules adopted Tuesday lay out plant count limits that are too small, and that they do not address Section 8 residents, who still cannot cultivate cannabis at home due to federal restrictions.

Also at Tuesday’s meeting, the CCB approved conditional adult-use licenses for 19 cultivators and 10 processors; the board has now issued 261 total conditional cultivator licenses and 25 total conditional processor licenses, Syracuse.com reported.

Denver City Council Approves Ordinance to Issue Cannabis Delivery Licenses to Social Equity Applicants

Denver City Council has approved a plan to issue cannabis delivery licenses exclusively to social equity applicants, as well as to lower the fees related to transportation licenses for the city’s transporters and dispensaries.

Passed Sept. 19, the ordinance decreases the $500 application fee and the $2,000 annual license fee for cannabis dispensaries to $25 each, according to a Denverite report. It also cuts the annual fees for transporters from $2,000 to $25, the news outlet reported.

In addition, the ordinance eliminates the option for retailers to use their own delivery services, ensuring that social equity operators are the only ones for the job, Denverite reported. Dispensaries can apply for their own transportation licenses again starting in 2024, according to the news outlet.

The Denver Department of Excise and Licenses initially put forth the proposal in July, and accepted feedback for two weeks before the city council reviewed the plan.
